Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the SkewLab platform at skewlab.io (the "Service"), operated by BoGames Software Ltd, a company registered in England and Wales under company number 17100237, with registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom ("SkewLab", "we", "us").

By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What SkewLab is — and what it is not

SkewLab is a software platform for quantitative analysis: it lets you build trading strategies and investment portfolios, run historical backtests, stress tests and simulations, and generate analytical reports.

SkewLab is not a financial adviser, broker, investment firm or portfolio manager. We do not provide investment advice, personal recommendations, solicitations or offers to buy or sell any financial instrument. Nothing in the Service — including backtest results, metrics, stress tests, Monte Carlo simulations, reports, or AI-generated suggestions — constitutes investment advice or a recommendation tailored to your circumstances. The Service is a general-purpose analytical tool; any output reflects exclusively the parameters you choose.

SkewLab is not authorised or regulated by the Financial Conduct Authority or any other financial regulator, and does not carry out regulated activities.

2. Eligibility

You must be at least 18 years old and capable of entering into a binding contract. If you use the Service on behalf of a company, you represent that you are authorised to bind it, and "you" includes that company.

3. Your account

You are responsible for the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorised use. We may suspend or terminate accounts that violate these Terms.

4. Your responsibility for investment decisions

Any strategy, portfolio, backtest or analysis created on the Service is created by you, under your exclusive responsibility. If you decide to invest real money based on anything produced with the Service, you do so entirely at your own risk. You can lose money — including all of your capital. We strongly recommend consulting a qualified, authorised financial adviser before making investment decisions.

To the maximum extent permitted by law, SkewLab accepts no liability for trading or investment losses, missed profits, or any decision you take based on outputs of the Service. Please read our Risk Disclaimer, which forms part of these Terms.

5. Market data — licence and restrictions

The Service includes market data (prices, volumes, reference data) licensed from third-party providers. You receive a personal, non-exclusive, non-transferable, revocable licence to view and use this data within the Service only, for your own analysis.

You must NOT:

  • redistribute, resell, sublicense, publish or otherwise make available the market data, in raw or derived-but-substitutable form, to any third party;
  • extract, scrape, bulk-download or systematically copy data from the Service;
  • use the data to build, populate or improve any dataset, product or service offered to third parties;
  • remove or alter proprietary notices.

These restrictions are required by our agreements with data providers and survive termination of your account. Breach entitles us to immediate suspension and may expose you to claims by the data providers.

6. Acceptable use of outputs

Backtest results, reports and other outputs are provided for your personal or internal business use. You may share individual reports privately (e.g. with your own adviser). You must NOT sell, license or commercially distribute the outputs of the Service — including backtests, reports or analytics — as, or as part of, a product or service that competes with or substitutes the Service, nor offer third parties backtesting or portfolio-analysis services powered by SkewLab, without our prior written agreement (see Institutional plans).

7. Acceptable use of the platform

You must not: attempt to breach security or access other users' data; reverse engineer, decompile or copy the Service; use automated means to access the Service beyond normal browser use; overload or disrupt the infrastructure; use the Service for unlawful purposes, including market abuse.

8. AI features

Some plans include AI-generated suggestions and analyses. These are produced automatically from the parameters and results of your strategies and portfolios; they are generic analytical observations, may be inaccurate or incomplete, are not investment advice, and must be independently verified before any use.

9. Plans, billing, cancellation

  • Paid plans are billed in advance by subscription (monthly or annual) through Stripe, at the prices shown at checkout, inclusive of applicable VAT unless stated otherwise.
  • Subscriptions renew automatically until cancelled. You may cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable.
  • Right of withdrawal (UK/EU consumers). You normally have 14 days to withdraw from a distance contract. By purchasing a subscription and requesting immediate access to the Service, you expressly consent to immediate performance and acknowledge that you lose the right of withdrawal once the digital service has been fully provided, and that if you withdraw during the 14-day period after having used the Service you may be charged proportionally for the service received, as permitted by applicable consumer law.
  • We may change prices with at least 30 days' notice; changes apply from your next renewal. If you do not agree, cancel before renewal.

10. Free plan and trials

We may offer a free tier or promotional trials, whose limits are described on the pricing page. We may modify or discontinue free features at any time.

11. Intellectual property

The Service — software, design, text, trademarks, and all related IP — belongs to BoGames Software Ltd or its licensors. Your strategies and portfolio configurations remain yours; you grant us a licence to process them solely to operate the Service (run backtests, generate reports, provide support).

12. Availability and changes

We aim for high availability but the Service is provided "as is" and "as available", without warranties of uninterrupted operation, accuracy of data, or fitness for a particular purpose. We may modify features with reasonable notice for material reductions.

13. Data accuracy

Market data and computed metrics may contain errors, gaps, vendor adjustments or methodological limitations (see the Risk Disclaimer for details, including dataset coverage limits). We do not warrant that any data or calculation is complete or error-free.

14. Limitation of liability

Nothing in these Terms excludes liability that cannot be excluded by law (including fraud, or death/personal injury caused by negligence). Subject to that:

  • we are not liable for indirect or consequential losses, loss of profits, loss of data, or trading/investment losses of any kind;
  • our total aggregate liability arising out of the Service in any 12-month period is limited to the amounts you paid us in that period (or £100 if you paid nothing).

15. Indemnity

You will indemnify us against claims by third parties arising from your breach of Sections 5 (data restrictions) or 6 (use of outputs), or from your unlawful use of the Service.

16. Termination

You may close your account at any time. We may suspend or terminate your access for material breach of these Terms, with notice where practicable. Sections that by their nature survive (5, 6, 11, 14, 15, 18) survive termination.

17. Changes to these Terms

We may update these Terms; material changes will be notified at least 30 days in advance through the Service or by email. Continued use after the effective date constitutes acceptance.

18. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales — except that if you are a consumer resident in the UK or EU, you retain any mandatory protections and jurisdiction rights of your country of residence.

19. Language

These Terms may be provided in several languages for convenience. In case of discrepancy, the English version prevails.
